Passed, awaiting effective date
South Korea
AI transparency

The South Korea AI Basic Act, passed in December 2024, is the first comprehensive AI law in Asia. It establishes an AI policy center, AI safety research institute, and a national AI commission, while focusing primarily on fostering and regulating the AI industry rather than addressing specific harms like deepfakes.

Passed December 2024; enforcement framework being developed; full applicability expected through 2026.

What it covers

  • High-impact AI systems with safety, transparency, and risk management obligations
  • Generative AI with content marking requirements similar to those in the EU AI Act
  • Both domestic AI providers and foreign providers operating in South Korea

Requirements and penalties

  • Risk management protocols for high-impact AI systems
  • Mandatory marking of generative AI output (analogous to EU Article 50)
  • National AI Commission oversight under the Ministry of Science and ICT
  • Implementing regulations and sub-rules being developed throughout 2025–2026
