Tennessee ELVIS Act

The ELVIS Act (Ensuring Likeness Voice and Image Security Act) was the first US state law to explicitly protect an individual’s voice from AI-generated replicas, expanding Tennessee’s right of publicity to address voice cloning specifically. The law passed in March 2024 with input from the Nashville music industry.

In force since 1 July 2024.

What it covers

  • A person’s name, photograph, voice, and likeness as a protected personal property right
  • Unauthorized commercial use including AI-generated audio simulating an individual’s voice
  • Both living individuals and the estates of deceased individuals

Requirements and penalties

  • Civil cause of action with treble damages available for knowing violations
  • Injunctive relief available to halt distribution
  • Defines “voice” broadly: a sound readily identifiable and attributable to a particular individual
  • Companion statutes SB 1346 / HB 1299 expanded coverage to synthetic intimate imagery in 2025
