TAKE IT DOWN Act

The TAKE IT DOWN Act is the first US federal law specifically targeting AI-generated content harms. It criminalizes the knowing publication of non-consensual intimate imagery including deepfakes (“digital forgeries”), and requires covered online platforms to remove reported content within 48 hours of valid notice.

Criminal provisions in force since signing on 19 May 2025; platform notice-and-removal deadline 19 May 2026.

What it covers

  • Authentic and AI-generated intimate imagery of identifiable individuals
  • A stricter standard for minors: any deepfake of a minor with intent to abuse, harass, or sexualize, regardless of distribution intent
  • Online platforms that primarily host user-generated content or are designed to publish such material

Requirements and penalties

  • Criminal: up to 2 years imprisonment for adult NCII; up to 3 years for content involving minors
  • Covered platforms must implement a notice-and-removal process and act within 48 hours of valid notice
  • FTC enforces platform obligations under the FTC Act; non-compliance treated as an unfair or deceptive practice
  • First conviction issued April 2026 against an Ohio defendant who used AI to create NCII of neighbors and minors
