South Korea Sexual Violence Crimes Punishment Act amendments

South Korea amended its Act on Special Cases Concerning the Punishment of Sexual Crimes in September 2024 to criminalize the production, distribution, possession, and viewing of sexually explicit deepfakes. The amendments removed the prior requirement to prove intent to distribute, aligning enforcement closer to strict-liability standards used in some jurisdictions for child abuse content.

  • Production, distribution, possession, and viewing of sexually explicit deepfakes
  • Both adult and minor victims, with elevated penalties for crimes involving minors
  • Telegram-based and other private channel distribution networks

Requirements and penalties

  • Up to 7 years’ imprisonment for production or distribution of sexually explicit deepfakes (raised from 5 years)
  • Up to 3 years’ imprisonment or ₩30 million ($22,600) fine for possession or viewing
  • Up to 5 years’ imprisonment for blackmail or coercion involving minors
  • National Centre for Digital Sexual Crime Response launched April 2025 to coordinate enforcement
