Australia Criminal Code Amendment (Deepfake Sexual Material) Act 2024

The Criminal Code Amendment (Deepfake Sexual Material) Act 2024 amended the Australian Criminal Code to create new offences for transmitting sexually explicit material, including AI-generated and altered content, without the depicted person’s consent. The amendment closed gaps in earlier law that did not explicitly cover deepfakes.

In force since 3 September 2024.

What it covers

  • Transmission of sexually explicit material, real or synthetic, depicting an identifiable adult without consent
  • Includes images and videos created or altered using AI; not limited to deepfakes
  • Operates via federal “carriage service” jurisdiction (telecommunications)

Requirements and penalties

  • Up to 6 years’ imprisonment for the primary offence
  • Up to 7 years’ imprisonment for aggravated offences (repeat offenders or creators of the material)
  • Operates alongside Online Safety Act 2021 civil penalties enforced by the eSafety Commissioner
  • First major case under Online Safety Act ordered A$343,500 penalty September 2025
